浅谈我国国家赔偿法的归责原则
【内容摘要】1994年5月12日，国家颁布施行《中华人民共和国国家赔偿法》。国家赔偿法规定了国家赔偿责任的归责原则，国家只有在符合归责原则所确定标准的前提下，才会承担自己行为给他人造成损失的赔偿责任。在国家赔偿法中，归责原则处于核心地位，它直接体现着国家赔偿的立法政策，反映了国家赔偿的价值取向。国家承担赔偿责任具体形式的归责原则是有过错原则、无过错原则、违法原则。根据我国国家赔偿法之规定，国家赔偿的归责原则为违法归责原则。本文基于对违法归责原则的理性分析，指出其不足，并尝试构建以违法归责原则为主，过错归责原则、无过错归责原则、结果归责原则以及过错加风险归责原则为辅，针对不同的国家职权行为以及不同领域适用不同归责原则的多元化归责体系，力求最大限度地寻求保护受害人合法权益与国家赔偿责任的协调统一。
