国家设定无限防卫权的目的在于对公民正当防卫权利的保护，鼓励和支持公民同违法犯罪行为作斗争，并对严重危及人身安全的犯罪分子进行警戒和震慑，同时避免行使正当防卫者受到不应有的惩罚，挫伤公民积极性。但是我们却不能忽视它在某种程度上有导致公民防卫权滥用的危险。某些防卫人可能会利用这一条款实施“无限度防卫”，出于报复心里仍然置不法侵害人于死地，造成“故意防卫过当”。这种以强暴制强暴的做法显然与正当防卫的立法意图不相符。
