Jake is a 24 year old post graduate student studying at the University of England and works part time in a construction company. Jake loves cars and makes it a duty to attend the yearly car exhibition in Melbourne. Jake has been to every exhibition since 2005. He attends the Melbourne car show on November 25 2009 and visits the second-hand car dealers’ section with the aim of buying a second hand Mercedes-Benz B 180. Jake has a budget of $50,000. He finds a B 180 in the colour of his dream and approaches Matt the sales representative on duty. Jake asks for the price. Matt replies that the selling price is $69,000 drive away. Jake says he is unable to buy a car that expensive; he says he could only afford to pay $50,000. Matt says it is impossible to find a B 180 for that amount. Jake later remembers his grandmother had given him a cash gift of $5,000, Jake then tells Matt that he likes the car and is willing to pay $55,000. Matt says the lowest the company can go is $65,000. Jake left that day and returns the next whereupon Matt informs him that the company is able to organise finance for the purchase. Jake says he is willing to consider the finance but he will need to seek legal advice and asks for a copy of the finance agreement. Matt tells Jake it is his company’s requirement that customers being considered for finance must sign a document authorising the company to seek finance on their behalf. Jake signs the document. Two (2) days later, Matt calls Jake informing him the company has obtained finance on his behalf and the car is ready for pick up.
Jake is no longer interested in the car and seeks your advice.
