第九条 劳动者主张加班费的,应当就加班事实的存在承担举证责任。但劳动者有证据证明用人单位掌握加班事实存在的证据,用人单位不提供的,由用人单位承担不利后果。
现行法律对追索加班费的案件举证并没有明确规定。在类似案件中,一般劳动者举证都比较困难,用人单位一般不会自觉拿出证据。该法条实际上是用法律手段督促用人单位拿出事实证据,维护劳动者的权益。同时,法条并没有倾向劳动者,用人单位举证的前提是劳动者有证据能够证明用人单位掌握加班事实存在的证据,这对于个别劳动者刻意刁难用人单位的行为也起到遏制作用。
对于加班行为,最高院认为企业生产经营也有淡季旺季之分,企业与职工通过平等协商,可以加班。用人单位让劳动者加班应支付加班费,但是加班要从劳动者的身体情况考虑,不能无度,不能强迫劳动者加班,劳动者有权拒绝加班.
