Bob talked with Nate, partner in the firm, who explained that Bob would not have to pay Nate Lawyer Firm anything unless and until they were successful in the suit; they agreed orally that there would be a contingent fee and Nate Lawyer Firm would receive 40% of the proceeds of the suit.

Nate Lawyer Firm received an offer for settlement from the defendant in the amount of $115,000.00. This offer was communicated to Bob, and Nate aggressively pushed for the rejection of the offer. Before Bob made any decision, Nate communicated to defendant’s insurance carrier that the offer was in fact, rejected.
Defendant’s attorneys indicate that no further settlement offer would be forthcoming, and as a result Nate Lawyer Firm informed Bob that they would no longer represent him in the case as they do not have the required resources to handle the litigation; Bob was never informed that the $115,000.00 settlement offer was rejected.
Following the news that Nate Lawyer Firm would no longer represent him, Bob became distraught. He was still convinced that Nate Lawyer Firm were specialists, and the only firm equipped to get him a "guaranteed" six-figure settlement.
