版权是由版权法设立及规管的合法权利，一般而言，版权是赋予原创作品拥有人的权利，可以存在于文学作品(如书籍及电脑软件)、音乐作品(如创作乐曲)、戏剧作品(如舞台剧)、艺术作品(如绘画、髹扫画及雕塑品)、声音纪录、影片、广播、有线传播节目和文学、戏剧及音乐作品已发表版本的排印编排，以及表演者的演出等。互联网传送的版权作品，也受保护。 事实上，获赋版权的作品，未必是饶有艺术价值、独具匠心或创意非凡的。即使简单如一帧普通的生活照，也可拥有版权。 版权是一项自动赋予的权利。在创作完成后，有关作品即拥有版权。版权与专利、商标及工业外观设计等其他类别的知识产权不同之处，就是版权毋须在中国中国香港注册，也可受法律保护。
