Governments are likely to continue to focus upon the capacity of dispute resolution mechanisms to affect investor confidence,minimize investment risk, and create incentives for investing abroad.Meanwhile, as the dispute resolution process at ICSID and other institutions gains momentum, investors are likely to become more sensitized to the benefits that treaty arbitration can offer both at the time of structuring the initial investment and dealing with problems after they arise.One should therefore continue to evaluate the possibilities and pitfalls inherent in this new form of dispute resolution to ensure that it plays a productive role in economic, legal,political and social development.
