摘要：刑事责任年龄制度在刑事领域有着极其重要的作用，刑事责任年龄是某一行为人是否能够承担相应刑事责任的前提和基础，也是决定某一行为人承担多大刑事责任的重要依据之一是我国刑法的重要内容。但是，我国现行对刑事责任年龄制度的规定存在许多缺陷，本文就我国现行刑事责任年龄制度的缺陷从以下三方面予以分析并提出完善建议，即在对完全不负刑事责任年龄人和免除了处罚的人构建以保安处分制度为中心的非刑罚处理方法体系；对刑事责任年龄上限在刑法修正案（八）的基础上予以完善；对相对负刑事责任年龄的入罪范围予以细化，从而使我国刑事责任年龄制度更加合理。
