Maintaining coherence between international trade law, international environmental law, and general international law presents a challenge for theory, legal doctrine, and state practice. The challenge is particularly evident when analysing how the international system - and the WTO in particular - can avoid conflicts between the goals of trade liberalization and environmental protection. The interpretation of GATT Article XX has begun to play a critical role in defining the relationship between different branches of international law.
GATT Article XX sets out fields of regulation in which WTO members are free to employ trade measures that would otherwise be inconsistent with GATT obligations. This limited freedom to use trade measures can be exercised at the national level or in other international agreements. Article XX thus plays a central role in determining "where decisions should be made ... for different subjects"(to borrow John Jackson's phrase) and, as a result, provides a key to understanding how decision-making authority is to be allocated among national governments and international institutions.
A relatively small number of disputes has arisen over the years regarding the application of Article XX exceptions to trade measures to achieve health or environmental goals. Some of these cases involved measures ostensibly aimed at protecting an interest inside the enacting country. Others involved measures aimed at changing the environmental policies of other WTO members. While few in number, these cases have left some interesting questions unresolved. No clear pattern has emerged regarding the matters covered by paragraph XX(b) and those covered by paragraph XX(g). Likewise, the issue of whether there is an implied jurisdictional limit in these paragraphs remains an open question. Thus, both the relationship between the headings of Article XX and the relationship between Article XX and general international law regarding the jurisdiction of states provide fertile ground for analysis. The Organization for Economic Co-operation and Development ("OECD") has developed a conceptual framework based on proximity-of -interest. This article shows how this framework can be applied to clarify the relationship between paragraphs XX(b) and XX(g) and to advance the jurisdictional analysis under Article XX. 展开
