本论文从电子废物的概念、分类及我国电子废物的回收、处置和污染现状入手,首先分析了电子废物对生态环境的危害,指出了目前我国电子废物管理中存在的问题。接着介绍了国外电子废物立法状况和主要的法律制度。着重以日本、美国、欧洲等国家作为研究比照的对象,比较其立法的基本情况以及立法中重要的两个问题:电子废弃物处理的责任承担及电子废弃物回收物流问题。然后论述了我国电子废物管理法律制度构建的指导思想和基本原则。最后在借鉴国外先进经验的基础上,结合我国的具体情况,重点构建了延伸生产者责任、押金、回收处理许可证、回收利用产业化及电子废物跨境污染防范及与此相关的“绿色壁垒”防范等几种管理法律制度,以期为我国电子废物管理立法提供一些有价值的研究成果。
