4. Seller acknowledges and agrees that time is of the essence with respect to its performance under this Agreement. Seller agrees it will promptly notify Buyer of any circumstance that might cause a delay of Seller’s performance beyond the date when Buyer is reasonably anticipating delivery and Seller will state the reasons for the possible delay. Seller agrees if seller take the responsibility of the delay they will use commercially reasonable efforts, at Seller’s sole expense, to cure any such performance delays and to perform as close to the anticipated performance dates as possible.
