all or some of the land covered by the accepted application is covered by an existing ML or included in an earlier application for a ML,
the land that is within the boundaries of the accepted application, and its surface, is taken to be excluded from the land covered by a MDL granted for the land on the accepted application.
However, the land is excluded land only:
while it is covered by an existing ML; or
until the earlier application for a ML is rejected or abandoned or while it is covered by the ML granted on the earlier application.
If excluded land within the boundaries of the MDL ceases to be excluded land, it is taken to be included in the MDL unless the MDL provides otherwise.
Applications for the grant of MDLs duly made in respect of or including the same land shall take priority according to the Minister's determination.
There is no provision in the MRA in relation to pre-existing EPCs or EPMs. Therefore, an MDL may be granted over an area that is the subject of a preexisting EPC or EPM.
Granting a ML:
(i) A ML will only be granted over an area which is subject to:
a pre-existing EPM, EPC, MDL or ML permit (existing authority); or
a pre-existing application for an EPM, EPC, MDL or ML (existing application),
if the applicant obtains the existing authority holder's written:
consent to the application in relation to the same minerals (or such purposes other than mining specified in the mining lease that are associated with, arising from or promoting the activity of mining); and
views on the application in relation to different minerals.
Applications for the grant of MLs duly made in respect of or including the sale area shall take priority according to the time of lodgement. The Mining Registrar(s) shall determine priorities of applications lodged simultaneously by ballot.
(2) Authorities to prospect (ATPs) overlapping mining tenements
(a) Preliminary tenement searches conducted with the DEEDI indicate that there are ATPs (also referred to by DEEDI as EPPs) which overlap the relevant EPCs. Therefore, we have included below a summary regime established under the
PGPSA to manage competing tenement holders and their interests in the land over which the EPCs are granted (including the legislation relevant to PLs).
If an ATP is granted over an area which is subject to:
a pre-existing ML (other than a transportation ML), an authorised activity for the ATP may be carried out on overlapping lands only if:
the ML holder has agreed in writing to the carrying out of the activity;
a copy of the agreement has been lodged with DEEDI; and
the agreement is still in force; and
a pre-existing EPM, EPC, MDL or transportation ML, the holder of an ATP may carry out activities, authorised under the terms of the ATP, on the overlapping land only if carrying out the activity does not adversely affect the carrying out of an authorised activity for the tenement that has already started.
If there is a pre-existing ATP:
