a mining tenement other than a ML (which includes a prospecting permit, mining claim, EPC, EPM and MDL) may be granted over the area. However, an authorised activity for the mining tenement may be carried out on the overlapping land only if:
the ATP holder has agreed in writing to the carrying out of the activity, a copy of the agreement has been lodged with DEEDI and the agreement is still in force; or
the carrying out of the activity does not adversely affect the carrying out of an authorised activity for the ATP that has already started; or
a coal or oil shale ML may be granted over the area subject to the existing ATP without obtaining the prior consent of the ATP holder by way of a determination of preference by the Minister (although the applicant is required to use reasonable attempts to consult with the ATP holder). The applicant for the coal or oil shale ML will be required to justify why their ML is an appropriate use of the resources in that area. The ATP holder will have the opportunity to make submissions as to why it should be granted a PL instead. However, it has been our experience that the Minister typically chooses not to make rulings on these overlapping tenement issues. Rather, it is the Minister's practice to encourage each tenement holder (or proposed tenement holder) to negotiate a workable solution between themselves.
(3) PLs overlapping EPCs, MDLs or MLs
(a) If a PL is granted over an area which is subject to:
(i) a coal or oil shale mining lease, it is a condition of the PL that:
the holder of the PL must continue to be a party to a coordination agreement; and
authorised activities for the PL must not be carried out if there is no coordination agreement,
in which case the activities of both holders are carried out in accordance with the coordination arrangement; and
a pre-existing EPM, EPC or MDL, an authorised activity for the pre-existing EPM, EPC or MDL may oniy be carried out on the overlapping land if:
the PL holder has agreed in writing to the carrying out of the activity;
a copy of the agreement has been lodged with the DEEDI; and
the agreement is still in force; and
a pre-existing EPM, EPC or MDL without obtaining the prior consent of the EPM, EPC or MDL holder by way of a determination of preference by the Minister (although the applicant is required to use reasonable attempts to consult with the EPM, EPC or MDL holder).
