摘要
由于质量技术监督部门的行政执法需遵循“先取证、后裁决”的原则，并且根据行政诉讼的要求，在行政诉讼中要证明自己的具体行政行为合法，所以本文就从行政诉讼的角度去探讨质量技术监督部门在合法的动机下循着法定处罚要件去取证然后裁决的行政处罚过程中的证据运用。质量技术监督部门行政处罚中的证据特点有技术性、重复使用性和证据程序性。
　　　在质量技术监督部门进行行政处罚运用证据时，需要非常准确、清楚地知道该部门的各证据种类的具体要求。知道具体要求，然后用合法的手段去收集，使之成为证据，这是证据运用的前提。本文按照行政诉讼法的证据分类将质量技术监督部门行政处罚中的事实证据及程序证据等予以归纳，然后从行政诉讼法的高度去分析该部门证据的具体要求。内容包括各证据种类包含的证据形式，证据形式的要求，怎样收集这种证据等。
