在当代国际法体系中，有关国际习惯的理论争议却颇多，使其地位显得尴尬。然而从理论与国际社会和各国的实践两大方面入手，结合国际习惯的发展历史和未来趋势分析，可以发现国际习惯始终并将继续占据国际法渊源的主导地位。以我国为例推及整个国际社会，习惯国际法占据国际法主导地位具有广泛的理论实践意义，并具良好的发展前景。

As an oldest form of the source of international laws, international custom has always occupied a vital position in the international legal systems. In contemporary international legal systems, there are a lot of theoretic controversies of international custom placing it in an embarrassing status. However, analyzing from the aspects of the relations between theory and the international community, and the practices of various countries, coupled with the development history and the future trend of international custom, it can be found that international custom is always and will continue to play a predominant role in the source of international laws. Take China for example and apply it to the international community, Customary International Law’s predominant role in the international laws has an extensive theoretical and practical significance, as well as a bright development prospect.
