The personal law
The personal law (lex personae) is not only a legal abstraction, not only a theoretical notion, but also a living phenomenon of legislation and practice. In case of a conflict legal system, the personal law must be determined in consideration of the element which is legally expressed relationship of a person to a State and through it to its entire legal system.
In Europe, the principle of nationality (lex partriae) became the determinant of the personal law in continental Europe in general. The lex personae was likewise adopted by the socialist countries. The principle of domicile is the general connecting factor of the personal law first and foremost in the common-law countries, but also in some others (e.g. Argentina). This is a strong connection, which establishes a kind of relationship, quite close to nationality, between the foreign State (host country) and the person choosing to reside in it with the intent of permanent or final settlement. 展开
