洗钱犯罪已有半个多世纪历史，其影响波及世界各国。20世纪80年代以来，随着世界经济的发展，洗钱犯罪在国际与各国刑法规范中发生了迅速变化。我国对洗钱罪的立法起步较晚，立法方面还显薄弱，司法实践中鲜有案例，迫切需要进一步研究洗钱罪方面的理论，以推动我国洗钱理论进步，强化我国洗钱罪的防范与惩治工作。本文在查阅、参考大量文献资料的基础上，结合我国洗钱罪的预防与惩治的现状，借鉴国际与外国在洗钱罪方面的理论与实践，从洗钱罪的概述、洗钱罪上游犯罪的认定、洗钱罪与相关犯罪的认定、洗钱罪共同犯罪的认定四个部分对洗钱罪的相关法律、理论与实践等问题进行较为全面的阐述。
文章第一部分列举了目前理论上几种洗钱罪的概念，并对洗钱罪的特征及构成要件进行了概述。
