在处理学生伤害事故时,学校责任如何界定是一个颇具争议的问题。未成年学生绝大多数时间都在学校里度过,他们的生活与学校发生着千丝万缕的关系。学校与未成年学生之间存在怎样的法律关系?学生伤害事故发生后,应适用哪种侵权责任的归责原则来确定学校责任?诸如此类的法律问题,我国法律未给出明确规定,不利于学生伤害事故的有效处理。关于学校责任的立法、执法噩待完善和加强,而立法、司法的实践又呼唤着关于学校责任成熟的理论指导。笔者在查阅大量理论书籍及法学论文的基础上,从学校和未成年学生之间法律关系的性质出发,采用文献法、比较法等,汲取众多法学、教育专家的理论营养,总结法官们智慧和丰富的审判经验,尽力分析学生伤害事故发生后,确定学校责任所涉及的重要法律问题,力求以此论文为我国关于学校责任的法制建设和理论研究尽一份薄力。经过比较、分析和研究,笔者得出以下结论: 展开
