8.1 the Purchaser acknowledges and agrees that the Delay Damages and the Performance Liquidated Damages are the extent and limit of the Supplier’s liability under this Contract for any breach of it. The Parties hereto agree that the Delay Damages and Performance Liquidated Damages are an agreed genuine pre-estimation of damage caused to the Purchaser for any non-performance of this Contract and adequate compensation for the relevant breaches of it and the Purchaser shall not claim any amounts in excess of such Delay Damages and Performance Liquidated Damages.
