陪审制度作为国家审判机关吸收并非职业法官的普通公民参与具体案件审判的一项司法制度，被世界众多国家所采用。但随着社会的不断发展，陪审制度在我国审判工作中适用亦存在着越来越多的问题，司法界对陪审制度在我国的存与废也各有主张。为此，本文从刑事审判的角度对陪审制度的适用进行了初步的探讨。
陪审制度的产生可谓历史悠久，世界上的两大主要法系，英美法系和大陆法系均采用陪审制度。如今我国司法界对陪审制度在人民法院审判中的适用问题亦有不同的见解，有的主张保留，有的主张废除。下面我们就在刑事审判的角度对陪审制度的适用谈一下看法。
