在知识经济不断发展的今天，与滥用知识产权相关的垄断问题层出不穷，基于反垄断法与知识产权的复杂关系,二者在根本宗旨与维护消费者利益方面具有一致性，但同时也存在冲突性，我们要明确使反垄断法与知识产权产生利益冲突的所在以及滥用知识产权的类型和受反垄断法规制的情形，协调反垄断法与知识产权的利益冲突，使其共同协调发展，为企业竞争提供良好的条件，为我国市场经济的发展创造一个公平自由的环境。在借鉴外国立法经验的基础上，总结我国现有与此相关的法律制度，综合考虑各种现实因素，从立法上，技术创新上等各个方面不断的完善我国与知识产权相关的反垄断法的法律制度，并注重反垄断法规制滥用知识产权的域外效力，维护国内经济安全，提高我国在国际市场上的竞争力。
