8.1The Parties acknowledge that, the conclusion of this Agreement shall not be deemed as allowing the Purchaser to asset or claim any interest or right over the intellectual property rights (“IP”) unless otherwise agreed herein. The Purchaser shall not register, or attempt to register, any rights (including but not limited to the trademark, copyright, patent, trade name, company name or domain name) that are resemble or similar to the IP, especially the trademarks, trade names, insignias or logos owned or licensed or that can be owned or licensed by the Supplier or its affiliates (“Marks”), or the abbreviation of such trademarks either in sound, appearance, meaning or translation in other languages. The Purchaser further acknowledges that, if any rights is registered in violation of the terms and conditions hereof, such registration and use shall be deemed as conducted in bad faith, regardless whether such trademark has caused or may cause misleading to the public.

双方承认，除非本协议另有约定，本合同的订立并不应被视为允许买方对知识产权主张任何利益或权利。买方不应注册、试图注册任何与知识产权相关或类似的权利，特别是提供方或其关联方所拥有的或可被授权的，以及提供方或其关联方能够拥有或能够被授权的商标、商号、记号或标识，或者以声音、外观、其它语言翻译其含义的形式所呈现的这种商标的缩写。买方进一步承认，如果违反此处约定而注册了任何权利，该注册和使用应被视为恶意，无论该商标是否会引起或可能引起公众的误解。
