The Code and Standard applied in each case shall be the latest revision adopted and published at the Bid closing date. Any conflict between different applicable Standards and Codes shall be referred to the Owner’s Engineer who will determine which shall govern and the Owner’s Engineer's decision will be final.
Alternative internationally recognized Codes and Standards such as DIN, BS, JIS, etc. are acceptable. The Bidder shall state in his Bid the Codes and Standards which are not in conformance with the Bid Document requirements together with a statement that in the Bidder's opinion the alternatives are equivalent or superior to those specified. If, during the evaluation period, the Owner’s Engineer has reasons to doubt the adequacy of alternatively proposed Codes and Standards, the Owner’s Engineer may request to substantiate that Bidder's proposed Codes and Standards are equivalent or superior to those specified.
The Contractor shall provide at no extra costs two (2) sets of all Codes and Standards, which will form the design basis for his plant and equipment. These Codes and Standards shall be submitted in the English language and latest at the time they are referred to by documents submitted to the Owner’s Engineer for design review.
If Codes and Standards other than those specified in the Bid Document are finally accepted, the Contractor shall submit an index tabulating the accepted Codes and Standards against the specified ones. Additionally the major differences between the accepted and withdrawn Codes and Standards shall be summarized.
No purchasing, fabrication or manufacture shall proceed until the Codes and Standards are approved in writing by the Owner’s Engineer.
