Indemnity Form – For Carriage of Perishable / Sea Products Cargo

Cargoes of a perishable nature which are liable to deteriorate or perish due to change in
climate, temperature, altitude, or other normal exposure, or length of time in transit for
carriage, will be accepted provided that it is recognized by the shipper that the carrier will not
be responsible for loss, damage or deterioration due to such causes.
Further when a shipment containing above articles is delayed in the possession of carrier, is
unclaimed or refused at place of delivery or for other reasons is threatened with deterioration,
carrier may immediately take such steps as it sees fit for the protection of itself and other
parties interest, including but not limited to the destruction or abandonment of all or any part
of the shipment.
HK Express Airways Limited shall not be liable to the shipper, consignor, consignee or any other
person in case a shipment perishes or spoils due to circumstances as described above, and the
shipper / consignor hereby agrees to release HK Express Airways Limited from and not make
any claim against HK Express Airways Limited in respect of, any liability in respect of the
perishing or spoiling of a shipment due to such circumstances.
Shipper / consignor further agrees to indemnify and keep indemnified HK Express Airways
Limited, its employees and agents from and against all loss, damage, costs, claims and expenses
incurred in respect of any liability whatsoever to any third party resulting from the perishing or
spoiling of a shipment in such circumstances.

咳咳,其实看在线翻译也看得很晕,只好勉强翻一下,你还是酌情参考吧
1.买方接收货物如因质量问题造成交易谈判的破裂,在达成拒绝合约后24小时及以后,货物的滞留费是卖家的责任,拒绝当日及先前累积的滞留费则是买家的责任。
2.由于卖方原因不能维持协议上的最小价格,或是货物运送与协定日期不和,而造成的任何额外的转换费和运费是卖方的责任。
3.在上述内容中,若货物的差异超过“容许范围”,买家和卖家应当交换有关集装箱重量的认证文件。若双方当事人都有该类证明,并且错误不能被评判,建议采纳最接近公共运输单据上数据的证明。卖家和买家应当接受货物地点以运输单据上的优先。若有一方缺乏该类证明,则以另一方提供的数据为准。
4.(这一条不是讲的水产之类的吧)若货物中携带的水分太多,买家有权利要求(应该是对货物质量数据)调整,只要可能,调整应处于一个平均湿度的空气氛围下。
