Waiver by the Department of any breach of any term, covenant or condition herein contained shall not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant or condition herein contained. The acceptance of rent by the Department shall not be deemed to be a waiver of any of the terms or conditions including the remedies o f Department hereof. No covenant herein shall be deemed waived by the Department unless such waiver is in writing by the Department.
The Department covenants that the Lessee, uponpaying the rent required herein and upon fulfilling all the conditions andagreements required of the Lessee, shall and may lawfully, peacefully andquietly have, hold, use, occupy and possess and enjoy the property during theTerm agreed upon without any suit, hindrance, eviction,ejection, molestation, or interruption whatsoever of or by the Department, orby any other person lawfully claiming by, from, under or against the Department.
