（1）不是由于收到信息一方的行为或者泄秘致使公众了解此信息的。
（2）在信息批露方通过直接或者间接方式获得此信息并进行批露之前，收到信息的一方已经获得了对此信息的合法所有权。
（3）由不受保密条款限制的第三方以合法方式批露给信息接受方的。
