法律与人情之争
各位评委，你们好：
我想先给大家讲一个我曾经听说过一个真实的故事：一对夫妇感情不和，丈夫经常会对妻子实行家暴。妻子为了女儿的学习与生活，一直忍气吞声。而面对频繁的家暴，妻子无法忍受丈夫对自己心灵和身体的创伤，于是将自己的丈夫残忍杀害。这个案件当时引起了很多人的关注，而就如何对这个妻子判刑，人们产生了激烈的争论。最后法院判处这个妻子为死缓。而这个案件，就向我们展现了法律与人情的强烈冲突。
法律与人情的冲突由来已久，在当今高速发展的中国社会，这个问题显得尤为突出。据有关部门反映，法院在审判的过程中，经常遇到类似的案件。而面对这样棘手的案件，考验的更多的是法官的智慧。
这种冲突出现的原因是多方面的，但主要有两个方面：一方面，由于中国法律的制定缺少对中国传统伦理价值观的考量，更多的是引进外来法律文化。公众缺乏对法律的理解和支持，法律意识淡薄。另一方面就是，人们无法真正的在法律与人情二者之间找到平衡点。
法律考虑人们情感的同时，也不能使得情感左右了法律。为了更好的将法律与人情结合起来，我想我们可以从以下两个方面入手：第一，建立陪审团制度。中国的司法审判具有封闭性，建立陪审员制度，可以使得司法审判在审理过程中就结合民意、结合公众伦理价值观，从而减小社会舆论的压力。第二，确立司法机关公正形象，进行广泛而持久的法律宣传活动。让公众了解法律，关心司法审判。从而降低公众对司法审判的误解，减少猜忌与怀疑。从这两个方面入手，我想对解决法律与人情问题之间的争论，会有所帮助。
作为一名法律专业的学生，我崇尚法律，但我也关乎民情。我想说，它们二者是平等的，具有同样的重要地位的。面对司法审判，我们应该不为外界事物的干扰，公正审判。面对公众，我们必须考量民众意愿，但不能滥情。因为维护社会正义，是我们的使命。
