在我国目前劳动争议处理中,是以仲裁为诉讼的前提,人民法院只受理劳动争议双方对仲裁裁决不服的劳动争议案件,也就是“仲裁前置”,《中华人民共和国劳动争议调解仲裁法》的相关规定也是在坚持这一劳动争议处理机制的基础上对劳动争议仲裁方面的问题进行的进一步的调整和完善。作为劳动争议仲裁机制的重要制度之一的仲裁时效制度在《中华人民共和国劳动争议调解仲裁法》通过之前存在不少的立法缺陷,这些缺陷的存在都极大地制约着劳动法律法规对劳动者合法权益的保障,而侧重于保护劳动者是劳动法律法规与生俱来的使命,劳动法律法规的基本价值取向是在保护用人单位的同时,侧重对劳动者合法权益的保护。在该法出台后,其中部分问题确实得到了很好的解决,但是仍然存在不少缺陷,不能达到劳动法律法规的立法宗旨,《劳动争议调解仲裁法》并没有将它们从根本上进行完善,使得我国目前关于劳动争议仲裁时效的相关法律规定仍然不能让劳动者的合法权益得到应有的、充分的保护。本文为了分析我国目前的关于劳动争议仲裁时效的法律法规规定的缺陷,并针对其提出合理的、可能的完善建议,将分为三章进行阐述,拟从现行法律法规的规定包括于2008年5月1日开始实施的《劳动争议调解仲裁法》的规定入手,提出法律法规规定存在的相关缺陷,进一步分析,寻求解决与完善的途径、办法。以期通过提出这些建议能够推进刚出台的《劳动争议调解仲裁法》得到进一步完善,更好的维护劳动者的合法权益。 展开
