郭稳才:鉴于世界500强等跨国公司组织结构复杂,分支机构多跨省市设立的实际,其工会组织形式、领导关系应当在坚持属地管理原则的基础上积极创新。对此全总相关文件规定:1.坚持以法人公司为单位建立基层工会委员会,实行属地管理。2.服务型法人公司及其下属跨地域的分公司(不具有法人资格)建立同一个基层工会委员会。分公司25人以上的建立分工会委员会,25人以下的建立工会小组,接受法人公司工会领导,同时接受所在地工会领导。上述考虑是基于企业是以法人为单位制定统一的包括劳动合同、工资福利、奖励办法以及安全卫生条件等劳动和人事管理制度规定的。分公司不具备上述权利。以法人单位建立工会,有利于工会代表包括分公司在内的全体职工参与企业民主管理,建立平等协商、集体合同制度等维权机制,有利于推进工会组建工作,维护职工的合法权益。
