B) SIZE PENALTY

I) US$ 0.50 PER MT SIZE PENALTY on natural basis fraction pro rata shall be applied to the quantities of fines above 10mm in excess of 10%.

II) US$ 0.50 PER MT on natural basis fraction pro rata shall be applied to the quantities of fines below 150 microns in excess of 30%.

C) MOISTURE

If free moisture loss at 105 degrees centigrade as finally determined pursuant to the provisions of clause 9 exceeds the guaranteed maximum referred to in clause 3, seller shall pay buyer full actual freight applicable to moisture over 8% for fines.

CLAUSE 8 DOCUMENTS

I) Seller shall provide buyer through negotiating and opening banks after reimbursement of sale proceeds with the following documents:

A) Complete set of "Clean on Board" shipped Bill of Lading made out to order, blank endorsed marked "freight payable as per charter party" notifying the applicant or their agents.

B) Provisional Invoice indicating the contract number, L/C number and name of the carrying vessel.

C) Copy of Fax of Seller advising shipment, if any, according to clause 12 of this contract.

D) Certificate of Analysis issued by Certifying Agency (ref. cl. 6.A.1) showing actual result of the test of chemical composition and all other tests called for in this contract.

E) Certificate of Weight issued by Certifying Agency (ref. cl. 6.A.1) Certifying the actual surveyed weight or cargo shipped at load port.

F) Certificate of Origin issued by Chamber of Commerce in India and detailing loaded quantity, commodity, carrying vessel, suppliers name and address.

G) To be distributed to the negotiating bank (original), A.3 copies, B.3 copies, C.3 copies, D.3 copies, E.3 copies or as per L/C stipulation.

II) To be distributed to the Buyer by fax first and then sent by airmail, (duplicate) A.2 non-negotiable copies, B.2 copies, D.2 copies (all non-negotiable copies), E.3 copies (all non-negotiable copies), and F.3 copies.

CLAUSE 9 WEIGHING

At the loading port(s), the Certifying Agency (ref. cl. 6.A.1) shall determine the weight of shipment of ore by draft survey. The weight of ore as ascertained and certified together with Certifying Agency’s analysis certificate(s) shall be basis of seller's provisional invoice(s).

Buyer shall, at buyer's expense apply the Entry-exit Inspection & Quarantine of the People's Republic of China (CIQ) for weighing at the port of destination.

The dry quantity shall be determined by deducting the free moisture referred to in clause 9 for such wet quantity. Seller may appoint CIQ as their representative for inspection at the discharge port. If there are differences of weight outturn over 0.5% then buyer and seller may consult, to settle the difference. If the draft survey is not performed at the discharging port Certifying Agency (ref. cl. 6.A.1) weight certificate(s) at loading port(s) will be regarded as final.
