Seller will include certain penalty and liability clauses for default in the FCO. Once material is presented for shipment, buyer will have seven days to accept and release payment – upon receipt of full payment to the seller, material will be released for transport to port. 100% TT wired against weight of ticket also accepted.
5. INSPECTION:
9.1 The buyer has the right to inspect the material at the stocking area. All mill certificates are available and shall be assigned to the buyer at the time of loading. Further, buyer has the right to inspection by SGS at buyer’s expense. Buyer will have seven days from availability to complete inspection or to waive inspection and accept material.
9.2 The Inspection Agency may inspect the Commodity and issue Certificates to certify that the Commodity inspected are meeting the Quantity (+/-5% allow) and Quality requirement of the Contract. Any weight deviations will be credited to the buyer or seller respectively.
6. PROCEDURES:
vi. The Seller reviews and confirms any changes made in draft contract by the Buyer. If the Seller agrees to the changes made by Buyer, the Seller issues the final binding contract via fax or email.
vii. The Buyer returns the final agreed contract duly signed and sealed via email or fax.
viii. The buyers open a Non operative financial payment instrument.
The buyer shall take possession of the first lot of material within 30 days of the execution of the contract or the seller may have the right to declare the contract null & void.
