摘要:食品是人类赖以生存和发展的最基本的物质条件,食品安全更是关乎国计民生。而食品安全监管问题是一个涉及经济学、法学、政治学、公共管理学等多学科的问题。为了促进我国食品安全保障机制的完善,本文通过对食品安全问题的反思,以及对引起食品安全问题的主要原因的经济学和法学分析,指出我国目前食品安全监管的不足。主要结论是:原料污染、食品添加剂、食品加工卫生、食品流通卫生、虚假标签等。其主要原因是:生产者食品安全的成本高、收益低,违法成本很低、被发现的风险很小;地方政府监管成本很大、而收益很小,地方保护主义严重;消费者维权成本高、时间多、取证难、获赔收益很小;食品安全法律法规存在缺陷、惩罚力度弱,违法受处罚的机会成本小;食品质量标准过低或者存在空白,质量检测程序和技术不高、成本高;消费者协会监管力度弱;法律对食品行业协会职权和责任规范不够,沦落为企业保护机构;食品行业过度竞争;食品安全问题曝光不够,媒体监督不够,食品安全事件给企业品牌、声誉、形象损失不大。提出的对策与建议有:加大食品市场的惩戒、监管力度,提高企业的违法成本;建立和完善统一协调、权责明晰的食品安全监管体系,有效降低政府食品监管的成本;加强食品安全知识的宣传教育,增强消费者的食品危机意识和维权观念;完善食品安全的法律法规;加快食品安全标准体系建设,加强检验机构体系建设,建立食品安全保障体系;通过法律明晰消费者协会、食品行业协会的的职责,保障其独立性;充分发挥行业协会和新闻媒体的作用,向消费者推荐优质食品,曝光不合格食品。

The main conclusion is: raw material pollution, food additives, food processing health, food hygiene, false label circulation. The main reason is: the producer of food safety, the high cost and low profits, very low cost, illegal was found little risk; The local government regulatory costs, while the benefits, a small local protectionism is serious; The consumers the high cost and the time, the difficult to obtain compensate income, obtain evidence is small; Food safety laws and regulations exist defects, penalty is weak, the opportunity cost of illegal be small; Food quality standards too low or existence blank, quality testing procedures and technology is not high, the high cost; Consumers' association weak supervision; Laws on food industry associations powers and responsibilities standard is not enough, reduced to enterprise protection agencies; The food industry excessive competition; Food security is not enough, the media supervision and not enough exposure, food safety accidents to the enterprise brand, reputation, image loss is not big.
