摘要：自2008年1 月1 日《职工带薪年休假条例》和9 月18 日《企业职工带薪年休假实施办法》的发布和实施以来，带薪休假制度便成为我国保障公民休息权的一项重要制度。但带薪休假制度无论是制度本身还是制度的实施都存在很多问题。应该如何完善带薪休假制度从而保障公民的休息休假权？本文围绕带薪休假制度展开，论述了带薪休假制度实施的现状和现存问题，并通过中国古代带薪休假制度和国外带薪休假制度与我国现存带薪休假制度的对比借鉴，最后提出了完善我国带薪休假制度的一系列建议。
