Each Party shall appoint an arbitrator and the two party-appointed arbitrators shall jointly indicate the Chairman arbitrator. Should an arbitrator be replaced under the Rules, the Party which appointed such arbitrator shall appoint a new arbitrator and, in case the arbitrator to be replaced is the Chairman arbitrator, the Party-appointed arbitrators shall jointly appoint such new Chairman arbitrator. The award shall be final, binding and shall apport the costs of arbitration to the losing Party, including reasonable lawyer’s fees incurred by the prevailing Party.
